UK Cosmetics Notified: Compliant from Day One

Post-Brexit, cosmetics sold in Great Britain must be notified through the UK Submit Cosmetic Product Notification (SCPN) portal with a UK-based responsible person. We manage the complete notification process and provide responsible person services for international cosmetics brands entering the UK market.

UK Cosmetics Regulation Post-Brexit

When the United Kingdom left the European Union, it established its own regulatory framework for cosmetics separate from EU Regulation 1223/2009. Great Britain (England, Scotland, and Wales) now operates under the UK Cosmetics Regulation, which requires cosmetic products to be notified through the UK SCPN portal before they can be placed on the market. Products notified under the EU CPNP system are not automatically valid for the UK market - separate UK notifications are required. Northern Ireland remains aligned with EU regulations under the Windsor Framework, creating a dual-compliance requirement for brands selling across the entire UK. Our team navigates this complexity, managing UK notifications through SCPN and EU notifications through CPNP as part of an integrated UK compliance service.

SCPN vs. CPNP: Understanding the Difference

The EU CPNP and UK SCPN systems were designed in parallel but are now separate databases. A product notified in CPNP for EU sale cannot be sold in Great Britain without a separate SCPN notification, and vice versa. We manage both systems for clients selling across the EU and UK, ensuring your compliance coverage is complete across all relevant markets without duplication.

Enforcement and Marketplace Requirements

UK Trading Standards and the Office for Product Safety and Standards (OPSS) enforce cosmetics regulations in Great Britain. Amazon.co.uk and other UK marketplaces increasingly require sellers to provide responsible person documentation and SCPN notification references. Non-compliant products face removal from UK marketplace listings and potential seizure by Trading Standards authorities.

Responsible Person Designation

The UK Cosmetics Regulation requires every cosmetic product placed on the Great Britain market to have a named Responsible Person established within Great Britain. This is not merely a documentation requirement - the Responsible Person bears legal accountability for ensuring the product's safety, maintaining the product information file, cooperating with enforcement authorities, and responding to safety concerns. For non-UK brands, this obligation cannot be fulfilled without a UK-based entity or a designated UK Responsible Person service. We provide Responsible Person services for cosmetics brands selling in Great Britain, assuming the legal obligations associated with this role and managing the day-to-day compliance activities it entails. Our Responsible Person service includes maintaining product information files, ensuring SCPN notifications are current and accurate, responding to OPSS and Trading Standards inquiries, and managing product safety communications when safety issues are identified.

What the Responsible Person Must Maintain

The Responsible Person must maintain a Product Information File (PIF) for each cosmetic product. The PIF includes the product description and name, cosmetic product safety report, description of manufacturing method, declaration of GMP compliance, evidence of claimed effects, and data on animal testing. We prepare and maintain complete PIFs for every product in your UK portfolio.

Transferring Responsible Person Status

Brands that have previously designated a different UK Responsible Person can transfer that status to our service. We manage the transition process including SCPN notification updates, PIF transfers, and communication with the outgoing Responsible Person to ensure no compliance gaps occur during the handover period.

SCPN Product Notification Process

The SCPN portal requires specific product data submitted in the correct format for each cosmetic product placed on the Great Britain market. Notification data includes the product name, product function category, frame formulation or full ingredient list in INCI nomenclature, the nanomaterial declaration where applicable, and the Responsible Person's details. Our notification team prepares SCPN submissions from your product formulation data, ensuring ingredient names are correctly expressed in INCI format and product categories are accurately assigned. We submit notifications before products are placed on the market - notification before first sale is a legal requirement, not a best-effort target. For existing brands that have been selling without SCPN notifications in place, we prioritize submissions and implement corrective procedures to resolve the non-compliance gap.

Cosmetic Safety Report

Every cosmetic product requires a safety assessment conducted by a qualified safety assessor before it can legally be sold in the UK. The Cosmetic Safety Report documents the safety assessor's evaluation of the product formulation, ingredient toxicological profiles, exposure assessment, and safety conclusion. We work with qualified safety assessors to prepare CSRs for your products, ensuring both the safety conclusion and the documentation format meet OPSS standards.

Nanomaterial and Sensitive Ingredient Notifications

Cosmetic products containing nanomaterials require additional notification to the relevant UK authority before products are placed on the market. We identify nanomaterial-containing ingredients in your formulations, prepare the required notifications, and ensure that all nanomaterial claims are correctly disclosed on product labels in accordance with UK regulation.

Label Compliance and Ongoing Management

UK cosmetics labels must comply with specific requirements including product name and function, list of ingredients in INCI order, net content, conditions of use and warnings, batch code, date of minimum durability or period after opening, country of manufacture, and the Responsible Person's name and UK address. Post-Brexit, products must use the UK address of the Responsible Person rather than an EU address, a common source of enforcement action against brands that did not update labels when Brexit took effect. We conduct label compliance reviews for every product before UK launch, checking every mandatory element against current UK Cosmetics Regulation requirements. We also monitor OPSS guidance updates and emerging enforcement priorities, alerting clients to label changes required by regulatory developments before products are affected.

Fragrance Allergen Disclosures

The UK has adopted enhanced fragrance allergen labeling requirements that mandate declaration of specific allergens above threshold concentrations on product labels. We review your fragrance compositions against the required allergen declaration list and ensure label declarations are accurate and complete.

Annual SCPN Notification Updates

SCPN notifications must be updated when product formulations change, when Responsible Person details change, or when product names are modified. We manage all SCPN updates as part of our ongoing compliance service, ensuring your notification database accurately reflects your current product portfolio at all times.
